The Trustees of the Country Hollow Village Condominium Trust, a Condominium established by a Master Deed dated October 8, 1987 and recorded with the Essex South District Registry of Deeds on October 15, 1987 in Book 9234, Page 386 and as further amended, pursuant to Section 5.13 - Rules and Regulations of the Declaration of Trust dated February 24, 1987 and recorded with the Essex South District of Deeds on October 15, 1987 in book 9234, Page 414 hereby amend the Rules and Regulations of the Country Hollow Village Condominium Trust, the original of which are attached as Appendix A to the above referenced Declaration of Trust as follows: Appendix A: For purposes of these rules and regulations, the term "resident" will mean and include all unit owners, their assigns or lessees, and all persons residing in a unit as their legal residence. Residents will be held responsible for the acts of guests visiting their unit. I. PROPERTY USE A. No part of the Property shall be used for any purpose except residential housing. Each unit shall be occupied as a single-family residence and shall be used for no other purpose, such as transient, commercial hotel/motel, or business purposes. No industry, business, trade, occupation or profession of any kind, commercial, religious, educational, or otherwise, shall be conducted, maintained, or permitted on any part of the Property. A. Nothing shall be done or kept in any Unit or in the Common Areas that will increase the rate of insurance of the Building, or contents thereof, applicable to the permitted use, without the prior written consent of the Board of Trustees. No resident shall permit anything to be done, or kept in his or her Unit, or in the Common Areas that will result in the cancellation of insurance of the Building(s) or contents thereof, or that would be in violation of any law.
III. RIGHT OF ENTRY A. The agents of the Board or the managing agent or manager or any contractor or workman authorized by the Board of Trustees or the managing agent or manager may enter any room or unit at any reasonable hour of the day, after resident notification, for the purpose of reconstructing and repairing adjoining units, inspecting for the presence of any vermin, insects or other pests and to perform any obligations of the Association required or permitted to be performed under the Master Deed and/or the By-laws of the Association. B. In extreme emergency cases, such as fire, immediate entrance into any unit will be at the discretion of the Board of Trustees or their agent, and the necessary public authorities who responded to the stated emergency. IV. COOPERATlON WlTH TRUSTEES A. All residents are required to cooperate with the Trustees in regard to their reasonable requests which are intended to assist the administration of the Condominium. Such requests may include, but are not limited to, personal information for purposes of safety, registry of pets, and identification of resident vehicles.
V. COMMON AREA A. The Common Areas shall be kept free and clear of rubbish, debris, and other unsightly materials. B. Residents may plant flowers in mulch beds situated around their unit. Flowers may also be planted in containers or in flower boxes, which are in keeping with the decor of the complex, on porches, decks or steps located in the front or back of their unit. At the end of the growing season, or earlier, all flowers that have died must be removed. Maintenance of flowers is the sole responsibility of the resident. Plastic flowers or plastic ornaments are not allowed. C. There shall be no obstruction of the Common Areas, nor shall anything be stored in the Common Areas without the prior consent of the Board, except as expressly provided in the By-laws. D. No disposal of harmful substances, such as oils or gas, is permitted on the Common Areas, or stored in open garages. E. No modifications may be made to the architectural and structural elements of the buildings or the exterior of the units without prior consent of the Board of Trustees. F. Nothing shall be altered or constructed in or removed from the Common Areas except upon the written consent of the Board of Trustees. G. Residents shall not cause or permit anything to be hung or displayed on the outside windows or placed on the outside walls or doors of a building and no sign, awning, canopy, shutter, radio or television antenna shall be affixed to or placed upon the exterior walls or doors, roof, or any part thereof or exposed on or at any window, without the prior consent of the Board of Trustees. One flag, no larger than 3’x5’, may be displayed with prior consent of the Board of Trustees. Welcome signs at the front entrances, chimes, and reasonable sized thermometers are acceptable. H. Outside doors and windows shall not be altered or replaced without prior written consent of the Board of Trustees, except peepholes, knockers, or nameplates affixed to steel doors. I. Outside lighting connected to each unit, such as deck and front entrance lights, is the sole responsibility of the owner. Replacement bulbs shall be white or clear in color. Replacement of fixtures must be in the keeping of the décor of the complex or approved by the Board of Trustees. J. Seasonal/holiday exterior decorations may be displayed. Holiday decorations shall be removed within two (2) weeks of the holiday. Decorations shall be limited to the front entranceway or deck of each unit. No decorations shall be allowed on any Common Area or garage. K. No sheets, clothes, blankets, laundry, rugs or any kind of other articles shall be hung out of a Unit or exposed on any part of the Common Areas. L. There shall be no parking of baby carriages or playpens, bicycles, wagons, children’s pools, toys, benches or chairs, on any part of the Common Areas overnight. Sandboxes shall be allowed on existing gravel, patio areas, or decks only. M. No entrance, stoop, porch or deck shall be furnished or used for the storage of vehicles or other items of individually owned personal property. Patio furniture and barbecues, in reasonable numbers and condition, shall be allowed on patios or decks. Barbecues may be placed on common areas up to one foot (1') from owner's deck, if placed on patio blocks. N. No trashcans belonging to residents shall be placed in the Common Areas except on the night before or the day of trash pick-up. All trashcans shall be removed from the Common Areas by the evening of pick-up day. No garbage cans shall be stored on decks or porches at any time.
VI. COMMON AREA CHARGES A. Prompt payment of condominium fees, by the first (1st) of the month, is required. Any payment received after the 15th of the month will be subject to a late charge, determined by the Board of Trustees. The Board of Trustees reserves the right to initiate legal action against any delinquent account. VII. RESIDENT BEHAVIOR AND RESPONSIBILITIES A. Each resident shall keep his or her Unit in good state of preservation, cleanliness and repair in accordance with the provisions of the By-laws. B. Nothing shall be done in any Unit that will impair the structural integrity of the building or structurally change the Building. C. No resident or any of his or her agents, servants, employees, licensees or visitors shall, at any time, bring into or keep in his or her unit any flammable, combustible or explosive fluid, material, chemical or substance, except such lighting and cleaning fluids as are customary for residential use. D. All radio, television or other electrical equipment of any kind or nature installed or used in each Unit shall fully comply with all rules, regulations, requirements or recommendations of the Board of Underwriters and the public authorities having jurisdiction, and the resident alone shall be liable for any damage or injury caused by any radio, television, or other electrical equipment in such Unit. E. Outside installation of alarms, bells, or horns for security systems require prior written consent of the Board of Trustees. All outside wiring for any equipment must have prior consent of the Board of Trustees. F. Each resident, individually, or as a member of the Board of Trustees, shall do his or her utmost to respect the privacy and quiet enjoyment of each other resident. G. No noxious or offensive activity shall be carried on in any unit, or in the Common Areas, nor shall anything be done therein, either willfully or negligently, that may be or become an annoyance or nuisance to the other residents. No resident shall make or permit any disturbing noises by him or herself, his or her family, servants, employees, agents, guests, or pets, nor do or permit anything by such persons or pets that will interfere with the rights, comforts, or convenience of other residents. H. The volume of television sets, radios, stereos, musical instruments and the like shall, at all times, be kept at a sound level which will not annoy the residents of neighboring units. Quiet hours are between the hours of 11:00 PM and 8:00 AM. I. Yard Sales are not allowed without prior consent of the Board of Trustees. VIII. PET RULES A. Pet owners are responsible for any property damage, injury and disturbances that their pet may cause or inflict. They shall be deemed to have indemnified and agreed to hold the Unit Owners Association, each Unit Owner and Declarer free and harmless from any loss, claim or liability of any kind or character. B. Every female dog while in heat shall be kept confined in the owner's Unit in such a manner that she will not be in contact with another dog nor create a nuisance by attracting other animals. C. No pet shall be permitted to bark, howl, whine or make other loud noises for such an unreasonable time as disturbs neighbors' rest or peaceful enjoyment of their Unit or Common Area. Per the Rules and Regulations, disturbing or annoying noises of any kind are not permitted between the hours of 11:00 P.M. and 8:00 A.M. D. All four (4) legged pets must be on a leash at all times and have direct (must be physically present) supervision by a responsible individual while in the Common Area. E. No pet shall be tied to, or leashed to elements of the Common Area without direct (must be physically present) supervision by a responsible individual (e.g., while a dog is tied to a deck, the responsible individual must be with the pet on the deck or Common Area at all times). Leash lengths must be short enough so pets do not disturb neighbors enjoyment of their Unit or Common Area, but are limited in length to ten feet (10') while attached to decks. (No uncoated linked chains are to be used as they will cause damage to the decks.) F. Owners are responsible, at all times, for the immediate removal of wastes of their pets from common elements and Units. G. Effective following the adoption date of these amended rules, property owners who rent or lease their property will not be allowed to rent or lease to individuals who wish to own, or bring in a pet(s). H. Property owners who are renting or leasing to individuals who currently house pets at Country Hollow Village, must obtain from the leaseholder a written agreement to abide by these rules, and submit a copy of such agreement to the Board of Trustees. Property owners are ultimately responsible for any penalties for violation of pet regulations and damages that may be caused to the Common Area. I. The Board of Trustees, upon approval of the application, shall return a copy of the signed "Pet Registration and Authorization" to the pet owner. J. All dogs must be licensed in the City of Haverhill and a copy of the license certificate must be sent to the Board of Trustees each time aforementioned license is renewed. K. All pets must wear a collar, choke chain, or harness to which the required license is securely attached. IX. PARKING A. Each unit is assigned two parking spaces. Units with attached garages have their garage and driveway. Units with detached garages have their garage and their assigned parking space.
Residents must make use of these two spaces. Any resident found continually parking on the street, in a visitor space, or a reserved space will be towed at their own expense.
B. Extra parking spaces located on Country Meadow Lane consist of visitor and reserved parking spaces. No resident may park in a reserved space that is not rented by them or in a visitor space. Visitor parking is on a first come basis.
One reserved parking space, if available, may be rented by any owner at the discretion of the Board of Trustees. No boats, recreational or utility trailers, campers, or commercial trucks are allowed. C. Boats, recreational/utility trailers, or campers may only be stored in unit owner's garages. D. Commercial vehicles with more than four (4) wheels are not allowed to remain in the complex except deliveries or services. E. No on-street parking by residents or guests shall be permitted between the hours of 12 Midnight and 6:00 A.M. Guests remaining overnight may make use of the visitor parking spaces on Country Meadow , or seek other alternatives. Violators will be towed at their own expense. F. No parking shall be allowed on any street of the complex by residents or guests during snow plowing or removal. Violators will be towed at their own expense. G. No resident or guest is permitted to park vehicles in designated fire lanes, around the rotary, or other restricted parking areas, or in front of hydrants, driveways, mailboxes, or entrances. No resident or guest is permitted to drive or park vehicles on Common Area grass or sidewalks. Violators will be towed at their own expense. H. Unregistered or inoperable vehicles are strictly prohibited in driveways or on Common Areas and shall be towed at the expense of the owner. I. Residents violating the parking rules and regulations shall be towed, without warning, at their own expense. J. It is the responsibility of each resident to inform their guests of parking restrictions. Violators will be towed at their own expense. X. SALES AND RENTALS A. Prior to the sale of any unit or the signing of any lease, the prospective resident must review Rules, Regulations and By-Laws of the Association and sign and return an acknowledgment of such, provided by the Association. A 6 D form (verification that Association dues are paid) will not be issued until this acknowledgment has been received by the Trustees. B. No "For Sale", "For Rent", or "For Lease" signs shall be maintained or permitted on any part of the Property or in any Unit therein except on weekends and Monday holidays. No exceptions will be permitted, and residents who fail to adhere to these provisions will be fined at a rate of $25.00 per day. C. All off-site unit owners shall register with the Board of Trustees, or their agent, the names, addresses, phone numbers, and length of lease for tenants in each unit owned by the unit owner. Owners shall obtain appropriate forms from the Board of Trustees or their agent. D. All off-site unit owners are responsible for the acts or omissions of any tenant(s) and shall be liable for violations of any rule, regulation, or fine incurred by said tenant. E. All off-site owners shall protect the rights of residents who reside in units adjoining the rental property by enforcement of excessive noise and parking regulations contained herein. F. Property owners are responsible and liable for the actions of their tenants. XI. VIOLATIONS AND RIGHTS A. Violation of any rule or regulation, or breach of any provision of the Trust, By-laws, Master Deed or of the offending unit owner's unit deed, shall give the Board of Trustees the right, in addition to any other rights, to enjoin, abate or remedy by appropriate legal proceedings, and either at law or in equity (or both) the continuation of any such breach. In addition to the fore-going, and not in substitution thereof, the Board of Trustees shall have the power to levy fines against residents for such violations. Collection of fines may be enforced against the residents involved as if the fine were Common Area charges owed by the particular resident(s). B. Any resident who wishes to report a violation of the Rules and Regulations should notify the Board of Trustees, management company or manager immediately, noting the violation and any other pertinent information such as violator's name, license plate number, if parking violation, and location of violation. C. Any unit owner aggrieved by any fine or penalty imposed by the Board of Trustees shall have the right to a hearing before the Board of Trustees, provided however, the said unit owner requests a hearing in writing within ten (10) days of the Trustee act or action which forms the basis of the grievance. Said hearing shall be held within fourteen (14) days of receipt of the written request for hearing and shall be conducted in closed session, unless the grievant requests in writing that the hearing be open to all residents.
A. The following fines may be applied in addition to any other penalties that may be incurred as stated in the Master Deed, By-Laws, and Condominium Rules and Regulations at the discretion of the Board of Trustees. The first imposed fine will be $50.00. The second imposed fine will be $100.00. The third imposed fine will be $200.00. Further offenses will result in imposed fines of $200.00 for each additional incident. Each day a violation continues, it is considered a separate violation. The Board has the right to levy fines against the Owners for violations of the Master Deed, By-Laws, and Condominium Rules and Regulations to govern the conduct of the Owners pursuant to Massachusetts General Law Chapter 183A. In case of persistent violation of the Master Deed, By-Laws, and Condominium Rules and Regulations by an Owner, the Board will pursue all actions necessary to remedy the situation.
XIII. AMENDMENTS AND REPEALS A. These Rules and Regulations may be amended from time to time by the Board of Trustees. B. Any consent or approval given by the Board of Trustees under these Rules and Regulations may be added to, amended, or repealed at any time by the Board of Trustees.
